Terms & Conditions
Last updated 3 August 2026
1. Who you are contracting with
SomaPlan is operated by SomaPlan ("SomaPlan", "we", "us"), trading as SomaPlan. By creating an account or continuing to use the service you agree to these terms. If you are using SomaPlan on behalf of a school, you confirm you have authority to bind that school; if you are using it as an individual, you confirm you are of legal age.
2. What SomaPlan provides
SomaPlan helps teachers working under Kenya's Competency-Based Education framework draft schemes of work, lesson plans, records of work and assessments (CATs and quizzes). We grant you a limited, non-exclusive, non-transferable right to use the service within your chosen plan. Documents are drafted with the help of automated AI systems and are a starting point for your professional judgement, not a substitute for it.
3. AI-generated content and accuracy
Generated content may be inaccurate, incomplete or not fully aligned with the latest KICD designs. You are responsible for reviewing, correcting and approving every document before using it with learners or submitting it to your school or the TSC. You are responsible for the material you enter as prompts or upload for grounding, and you confirm you have the right to use it. You must not use SomaPlan to produce unlawful, hateful, deceptive or exam-integrity-violating content, and we may filter outputs, remove content or suspend accounts that do. Rights holders may contact us at speedyhanieldevelopers@gmail.com to request takedown of infringing material; repeat infringement results in account termination.
4. Acceptable use
You must not misuse the service. In particular, no unlawful use, fraud or spam, no infringement of intellectual property, no attempt to interfere with security (malware, probing, scraping or circumventing plan limits), no reverse engineering, and no resale or redistribution of the service. You must keep your login credentials confidential and are responsible for activity under your account, and you must provide accurate account details and keep them up to date.
5. Your content
You keep ownership of the class information you enter and the documents you generate. You grant us a limited licence to host and process that content solely to operate the service for you.
6. Our intellectual property
We retain ownership of SomaPlan itself — the software, interface, prompts, documentation and branding. Nothing in these terms transfers that ownership to you.
7. Service availability
We work to keep SomaPlan available, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim implied warranties, including merchantability and fitness for a particular purpose.
8. Payment, subscriptions and taxes
Paid plans are billed monthly or yearly in advance and renew automatically until cancelled. You can switch plans or cancel at any time from your profile page; cancellation takes effect at the end of the period you have already paid for. Payment, billing, tax, cancellation and refund mechanics are covered by Paddle's Buyer Terms.
9. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
10. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. You may close your account at any time. After termination you can request an export of your documents for 30 days, after which your data may be deleted.
11. Liability
To the extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months before the claim, and we exclude indirect, consequential or special damages including loss of profits, data or goodwill. Nothing excludes liability for fraud, death or personal injury where the law does not allow it. You indemnify us against claims arising from your content, unlawful use or breach of these terms.
12. General
These terms are governed by the laws of Kenya and disputes are subject to the courts of Kenya. You may not assign your rights without our consent; we may assign ours in a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. Questions: speedyhanieldevelopers@gmail.com.
